1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the Spunchy mobile application, website, and associated services (collectively, the "Platform"). By registering, accessing, or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must not use the Platform.

2. About Spunchy

Spunchy is a technology platform that connects individuals seeking shared mobility solutions. Our services include:

Intercity Carpooling: Shared rides between cities at agreed fuel-cost contributions
Intracity Carpooling: Shared rides within a city or metropolitan area
Car Travel: Full-car bookings for private point-to-point travel
Bike Travel: Two-wheeler rides for short and medium distances
Car Rentals: Self-drive or driver-assisted rental vehicles

    Important: Spunchy acts solely as a technology intermediary. We do not own vehicles, employ drivers, or operate as a transportation company. All travel arrangements are between users directly.
  

3. No Payment Processing

Spunchy does not handle, process, collect, or manage any payments between users. All financial transactions — including fuel-cost sharing for carpooling, fees for bike or car travel, and rental charges — are agreed upon and settled directly between the parties involved (rider and driver, or renter and vehicle owner).

Spunchy bears no responsibility or liability for any payment disputes, non-payment, fraud, or financial losses arising between users. Users are advised to exercise due diligence before agreeing to and making any payment.

4. User Eligibility & Registration

4.1 Eligibility

You must be at least 18 years of age
You must possess a valid government-issued identity proof
Drivers must hold a valid, current driving licence for the class of vehicle being offered
You must provide accurate and truthful information during registration

4.2 Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must immediately notify Spunchy at support@spunchy.app if you suspect any unauthorised access to your account.

5. User Conduct

All users of the Spunchy platform agree to:

Treat fellow users with respect and courtesy at all times
Not engage in harassment, discrimination, or abusive behaviour
Not carry prohibited, illegal, or dangerous items during any trip
Not misrepresent vehicle details, identity, or travel plans
Comply with all applicable traffic laws, road safety regulations, and local ordinances
Not use the platform for any illegal, fraudulent, or harmful purpose

Violation of these conduct standards may result in account suspension or permanent ban without prior notice.

6. Driver Obligations

Drivers who list rides or vehicles on the Spunchy platform agree to:

Maintain valid registration, insurance, and roadworthiness certification for their vehicle
Hold and carry a valid driving licence at all times while operating
Ensure the vehicle is clean, safe, and in good mechanical condition
Adhere to the agreed pickup and drop-off points
Not consume alcohol or any intoxicant before or during a trip
Accept only the agreed number of passengers and not overload the vehicle

7. Rider Obligations

Riders agree to:

Be at the agreed pickup location on time
Inform the driver promptly if plans change or the booking is cancelled
Respect the driver's vehicle and not cause any damage
Adhere to agreed seat-sharing arrangements and trip details

8. Safety

User safety is paramount to Spunchy. We strongly encourage all users to:

Share trip details with a trusted contact before travel
Use the in-app emergency feature (where available) during distress
Report unsafe behaviour, accidents, or incidents immediately via the app or at safety@spunchy.app

Spunchy reserves the right to take appropriate action, including account suspension, following any verified safety complaint.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

Spunchy is not liable for any injury, loss, damage, or harm arising from trips arranged through the platform
Spunchy does not guarantee the accuracy of user-submitted information, including vehicle details or identities
Spunchy is not responsible for payment disputes or financial losses between users
Spunchy is not liable for delays, cancellations, or no-shows by drivers or riders

    Our aggregate liability to any user, under any cause of action, shall not exceed INR 1,000 (Indian Rupees One Thousand).
  

10. Intellectual Property

All content, trademarks, logos, software, and materials on the Spunchy platform are the exclusive property of Spunchy Technologies Pvt. Ltd. You may not reproduce, distribute, modify, or create derivative works without prior written consent.

11. Termination

Spunchy reserves the right to suspend or terminate your account at any time, with or without cause, including for breach of these Terms, fraudulent activity, or conduct that harms other users or the platform. You may also delete your account at any time through the app settings.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms or the Spunchy platform shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana. We encourage users to first attempt resolution through our support team at support@spunchy.app.

13. Changes to Terms

Spunchy reserves the right to modify these Terms at any time. We will provide reasonable notice of material changes via the app or registered email. Continued use of the Platform after the effective date of changes constitutes acceptance.
